Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") are a legal agreement between you and [MIDI DUMB legal entity name — TBD] ("MIDI DUMB", "we", "us"). By creating an account, ticking the "I agree" box at sign-up, downloading or using the MIDI DUMB RPG application or website (together, the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least [minimum age — e.g. 16/18, TBD with lawyer] years old to use the Service.

2. What MIDI DUMB is

MIDI DUMB RPG is a tool that generates and manipulates parameter settings ("presets") and sends MIDI messages (including CC, NRPN and SysEx) to your own hardware MIDI devices such as synthesizers and effects units. The Service is intended to help you create and explore sounds on gear you already own.

3. Beta software — provided "as is"

The Service is currently in beta and is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, reliability, availability, or that the Service will be error-free or uninterrupted. Features may change, break, or be removed at any time.

4. Your hardware — use at your own risk

The Service sends MIDI messages to hardware you connect to it. You use the Service with your hardware entirely at your own risk. To the maximum extent permitted by law, MIDI DUMB disclaims and accepts no responsibility or liability for anything that happens to your equipment — including any damage, malfunction, data loss, or changed/erased settings, patches, or presets on your synthesizers, effects units, or other devices.

MIDI-driven parameter changes can occasionally put a device into an unexpected state. This is almost always temporary: the recommended first step is simply to power the device off and back on, which restores normal operation. Keeping backups of your own hardware patches is your responsibility.

5. Audio, speaker & hearing safety

Randomized presets can produce sudden, loud, or high-level audio output. Such output may damage speakers, headphones, studio monitors, amplifiers, or your hearing.

Before generating or randomizing sounds, keep your speaker, monitor, amplifier, and headphone levels low, and raise them gradually. Never randomize with your output volume set high. To the maximum extent permitted by law, MIDI DUMB accepts no liability for damage to equipment or hearing resulting from audio output produced with the Service. You are responsible for protecting your equipment and hearing.

6. Accounts

You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate information and to keep it up to date. We may suspend or terminate accounts that violate these Terms.

7. Credits, billing & cancellation

MIDI DUMB RPG is free to download and use. Generating a sound (a "randomize") spends Credits — 1 Credit per randomize. Other features — saving presets, the preset library, browsing history, hotloads, and locks — do not cost Credits. When your Credit balance reaches zero you can still use every other part of the app; you simply cannot randomize again until you add more Credits. There is no recurring charge required to use the Service.

You can obtain Credits in two ways. Current amounts and prices are shown on our pricing page and may change with notice:

• Credit Packs (one-time). A single, non-recurring purchase that adds a fixed number of Credits to your balance. Credit Pack Credits do not expire — they stay in your account until you use them.
• Membership (recurring). A monthly subscription that adds Credits to your balance each billing period. Membership Credits accumulate while your membership is active.

• Billing. A Membership renews automatically at the start of each billing period until cancelled; you authorize us (and our payment processor) to charge your payment method on each renewal. Credit Packs are one-time charges and do not renew.
• Cancel anytime. You may cancel your Membership at any time; it will not renew after the current period.
• No refunds / no proration. We do not provide refunds or prorated credits for Credit Packs, or for the current or past Membership billing periods.
• What happens to your Credits when a Membership ends. Credits from Credit Packs and your free starter balance never expire. Credits that were added by an active Membership remain usable for 28 days after the end of your final paid Membership period, then expire.
• Your saved work is kept. Your saved presets, hotloads, and history remain in your account and stay readable and exportable regardless of your Credit balance or Membership status. We recommend you also keep your own local backup (see the Privacy Policy and the in-app export).
• Price changes. We may change prices and Credit amounts; changes apply to future purchases and future Membership billing periods, and we will give reasonable notice.
• [EU/consumer-law note — lawyer to confirm: where legally required, a statutory right of withdrawal (e.g. 14 days) may apply to a Credit purchase or Membership; by choosing to spend Credits (i.e. beginning to use the digital content) during that period you may be agreeing to waive/forfeit that right. Finalize wording per applicable jurisdictions.]

[If billed through the Apple App Store or Google Play in future: purchases and refunds are handled by Apple/Google under their terms, and cancellation/refund requests must be made through them. Lawyer to confirm.]

8. Free access & starter Credits

The MIDI DUMB RPG application is free to download and use, including all synths and all features. New accounts include a starter balance of Credits (currently 50) so you can try generating sounds right away. No payment method is required to create an account or to use the app.

Running out of Credits does not lock the app or delete anything: your account stays open, your saved presets, hotloads, and history stay accessible, and every feature except generating a new sound keeps working. To randomize again once your balance reaches zero, you add more Credits via a Credit Pack or a Membership as described in Section 7.

9. Preset license — what you may and may not do

Subject to these Terms, we grant you a non-exclusive, worldwide, royalty-free, perpetual license to use presets you create with the Service in your own music — including commercial releases — as part of your recordings and creative works.

However, you may NOT sell, license, sub-license, redistribute, share, or repackage the presets themselves — including as .mdpr files, preset packs, preset banks, or sound libraries — even if you have modified them. In short: use the sounds you make in your music freely; do not resell or redistribute the presets as products in their own right. This restriction is modeled on standard sound-content licenses in the industry.

10. Acceptable use & user content

You agree not to misuse the Service, including: attempting to reverse-engineer, extract, or redistribute the underlying synth data, recipes, or generation logic; interfering with or overloading the Service; violating the preset license above; or using the Service unlawfully. If the Service lets you share content (such as presets or words), you are responsible for what you submit, and you grant us a license to host and display it for the purpose of operating the Service. We may remove content or restrict features at our discretion.

11. Your data & privacy

We collect and process personal data (including your name, email, and your activity within the app) to operate and improve the Service, as described in our Privacy Policy. By agreeing to these Terms you also consent to that collection and processing.

12. Intellectual property

The Service, including its software, synth database, generation logic, branding, and content (other than your own saved data and your music), is owned by MIDI DUMB or its licensors and is protected by intellectual-property laws. These Terms do not transfer any of those rights to you.

13. Limitation of liability

To the maximum extent permitted by law, MIDI DUMB and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising from or related to your use of (or inability to use) the Service — including, without limitation, any damage to hardware, speakers, or hearing as described in Sections 4 and 5. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service is limited to [the greater of the amount you paid us in the 12 months before the claim, or a nominal cap — TBD with lawyer].

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including Sections 4, 5, 9, 12, 13) will survive.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you or ask you to accept the new version. Continued use of the Service after changes take effect means you accept the updated Terms.
